Worry Free Bad Check Collection Associate Agreement

Recovery Data Services, Inc. (RDS, Inc.) provides a Worry Free but extremely effective service to our clients (after a one-time enrollment fee of $49). We are able to turn NSF (Bad) checks into electronic debits and recover the funds directly from the Bad check writers account. Rather than having our clients redeposit bounced checks and incur additional fees, we provide a form that will instruct the client's bank to immediately forward all returned checks directly to our processor. Our service is very effective for small or large companies and does not require any monthly fees or equipment to purchase.

For a one-time investment of $49, RDS, Inc. provides you with a Username and Password to access the associate area of this website. In the associate area you will find Sales Aids and Tools to use to present this Worry Free Check Collection Service to any business in the United States.

You hereby agree to represent RDS, Inc. in a professional manner and put the interests of our clients first. By doing so, you will develop long term relationships and maintain your residual income for years to come, as long as you remain "ACTIVE" in your business. ACTIVE means that you continue to work this business and submit at least one new client per month or maintain a three month running average of 100 checks & fees collected each month as a result of your efforts. RDS, Inc. reserves the right to suspend your "ACTIVE" status and you agree to forfeit all monies due during any period you're "NOT ACTIVE".

A representative of RDS, Inc. will normally be available 9:00 a.m. to 6:00 p.m. Pacific Time - Monday thru Saturday to answer questions, do 3-way calls and provide assistance to you in running your business.

We will also provide co-branding help and customized forms for any organization that wants to offer our Worry Free Check Collection Service to their membership base. ZERO TOLERANCE SPAM POLICY !!!!

RDS, Inc. will NOT Tolerate the Use of SPAM . . .
DON'T DO IT and Risk Losing a Lifetime of Residual Income.

For the purpose of our policy, SPAM is sending an e-mail or FAX to someone who DID NOT request it, whether it is just one e-mail or a Bulk E-mailing to some "So Called SAFE LIST". If they didn't request information, don't send e-mail about our services PERIOD! This includes sending "Legal" Unsolicited Commercial Electronic Mail, because most recipients don't know what constitutes a "Legal" mailing and can still send SPAM complaints to the ISP. Furthermore, NEVER include a direct link to our website in an e-mail, unless you have first personally talked to a business prospect and they have agreed to receive an e-mail from you.

All it takes is one SPAM complaint to get our website shut down and if we determine who the responsible party is, your agreement will be cancelled and you will be banned from representing our company in the future. You also hereby agree to forfeit all future commissions if you are caught SPAMMING! We are on many of the "So Called SAFE LISTS", so don't risk using them, because if we get just one copy of your forbidden e-mail, you are history - ZERO TOLERANCE Means Just That!

As a representative of RDS, Inc., you will be an independent contractor. You must identify yourself as such and not imply that you are an employee of RDS, Inc. You will be running your own independent business and be responsible for any and all taxes due on any monies received from RDS, Inc. In any year that you receive an amount of commissions greater than the legal reporting threshold, we may be required to report your compensation as an independent contractor to the IRS. We hope this amount will be far greater than the reporting limits and we will work hard to make that happen for you. This will also require a maximum effort on your part.

You will receive compensation, no less frequently than monthly, based upon a percentage of the allowable state fees for each check with fees we collect as a result of your efforts. All businesses you sign up will become RDS, Inc. clients but will be assigned to you for commission payments for as long as you remain active with the company. Your percentage compensation of the state fees collected will be set to a minimum of 30% initially and then will be adjusted upwardly based upon the prior commission period's number of checks collected for all your assigned clients combined. The % will be as follows, subject to change, but never lower than 30%.

100 Checks w/fees collected last period = 35% commission this period
250 Checks w/fees collected last period = 40% commission this period
375 Checks w/fees collected last period = 45% commission this period
500 Checks w/fees collected last period = 50% commission this period

The check count will be based upon check fee payments received and reported by our RCK processor, divided into 12 commission periods annually and will not necessarily start and end exactly on the first and last day of each calendar month. Note: Checks collected without collecting our fees, don't count in the totals. This is because we make our money on the fees and return the check amount to our clients.

In addition, RDS, Inc. will pay you $25 for each $49 one-time enrollment fee collected from new clients. Enrollment fees received and then cleared into the company account each month will be paid to you along with any regular commission transfer coming to you for the prior month. So, in order to recoup your initial investment and make your first buck in this business, just sign up two new clients.

Associates are forbidden to accept cash or any other direct form of payment from any RDS, Inc. client, other than a check made out and mailed immediately to Recovery Data Services, Inc. Acceptable forms of payment for the $49 one-time enrollment fee will be by Online Check at: http://www.recoverydataservices.com/fee.html, or Check by phone at (800) 266-6305 - 9:00 a.m. to 5:00 p.m. Pacific Time - Mon. to Sat. when available, Client Business Checks made out to RDS, Inc. ONLY and mailed to Arizona PO Box or by a signed ACH authorization form on the Merchant Set-up Checklist and Faxing it to (877) 904-1726 along with the other required items.

Accepting a cash payment from any client is cause for immediate cancellation of this agreement and forfeiture of all commissions owing. DON'T DO IT and risk a lifetime of future income.
